Thrive Wellness Systems, Melbourne, Australia (“we”, “us”, “our”) provides the Fuck the Overwhelm Club service (“Service”) to you (“you”, “Client”). By signing up and paying the first invoice, you agree to these terms. All prices are in USD.
1. What the Service Includes (Scope)
We provide proactive WordPress site care for your existing site:
- Migration to premium Kinsta hosting (zero-downtime, Melbourne-timed). All emails must be migrated to Google Workspace or Zoho, as Kinsta does not host email.
- Weekly tested updates (WordPress core, themes, plugins—staging first).
- 24/7 uptime & security monitoring.
- Daily tested backups.
- Monthly performance, accessibility, and revenue-leak checks + fixes.
- Emergency support during Melbourne business hours.
- Monthly health report.
- Access to our archive of monthly project guides (detailed step-by-step no-code solutions to common wellness setup gaps).
- One or two incremental improvements per month (e.g., fix a form, optimise images).
What’s NOT included (extra work, quoted separately or at $150/hour):
- Major redesigns, new features, or big builds (that’s Empire Co-Conspirator or Custom Builds).
- Content creation/editing.
- SEO strategy or marketing.
- Fixing issues caused by high-risk setups (see Section 6).
- Work outside WordPress (e.g., third-party apps unless integrated).
2. Pricing & Payment
- $349 USD/month.
- First month payment includes migration and setup (paid upfront).
- Billed monthly via Stripe on the 1st (or signup date anniversary).
- Immediate cancellation anytime—no notice required. We’ll complete the prepaid month and help transfer to another developer by the end of service (or hand back Kinsta hosting to you).
- Late payments: We’ll retry in 3 days. If it fails again, service will pause (may result in hosting suspension, as hosting is included).
- Price changes: 30 days’ notice by email.
3. Your Rights
Under Australian Consumer Law you have strong rights that we can’t take away:
- Services must be provided with due care and skill.
- Services must be fit for purpose (we’ll fix if they’re not).
- If something goes wrong due to our fault, we must remedy it (repair, replace service, or refund).
- You can cancel immediately anytime (no penalties).
- You own your site, content, and data forever—we hand over everything on exit.
- We guarantee 99.5% uptime (if we miss it in a month, that month is free).
- You can ask for a report on work done at any time.
We stand behind our work. If you’re not happy with the value in the first 30 days, tell us—we’ll make it right or refund.
4. Your Responsibilities
To keep the Service safe and effective, you agree to:
- Give us secure, up-to-date access (logins, hosting details) when asked.
- Not make big changes (e.g., install risky plugins) without telling us first.
- Tell us promptly about any issues (e.g., “site feels slow” or “strange login attempts”).
- Not share your site logins with untrusted people.
- Pay on time.
- Only use the Service for a body-positive/weight-neutral wellness business (our non-negotiable values).
If you breach these, we may pause work until fixed (with notice).
5. Our Guarantees & Limits
- Uptime: 99.5% or that month free (calculated via Kinsta + our monitoring).
- Response: During Melbourne business hours for emergencies.
- Liability cap: Our total liability is limited to the fees you paid in the last 12 months (except for fraud or personal injury, where law requires more).
- We aren’t liable for:
- Downtime from your internet/hosting issues outside our control.
- Hacks/losses from your weak passwords, phishing, or high-risk practices.
- Business losses (e.g., lost bookings) unless caused directly by our negligence.
- We use best efforts but can’t guarantee 100% hack-proof (no one can).
6. High-Risk Configurations – Extra Charges Apply
Some setups create serious security or stability risks for us (and your site). If your site has any of these, emergency fixes or extra work needed to make it safe/maintainable will be charged at $150/hour (with your approval first, except true emergencies where we act to prevent major harm then invoice):
- No staging/sandbox environment for testing updates (we can’t safely test without risking live site).
- File manager plugins (e.g., old versions of File Manager, WP File Manager) that let anyone upload files without proper checks.
- Nulled/cracked/pirated plugins or themes (these often contain malware/backdoors).
- Direct file editing in production (no version control or staging).
- Very weak security basics (e.g., “admin” username, no 2FA, file permissions 777).
- Multiple outdated/high-vulnerability plugins that conflict or are known risks.
- Custom code that bypasses WordPress security (e.g., direct database edits via plugins).
We’ll flag these in your initial audit and give you options to fix (e.g., remove risky plugin). If you choose to keep them, any emergency/unplanned work caused by them is billable. We may recommend upgrading to Empire Co-Conspirator for more hands-on help.
7. Termination & Exit
- You can cancel immediately anytime.
- We can end if you breach terms (e.g., non-payment after reminders, unsafe practices ignored).
- On exit: We provide full site export, access handover, final report, and lifetime guide access.
- Pro-rated refund for unused time.
8. Privacy & Data
We handle your data per our Privacy Policy (link on site). We only access what we need for the Service and delete client data 90 days after cancellation (except backups you request).
9. Disputes
Australian law applies. If there’s a problem, let’s talk first. If needed, use mediation or Australian courts.
10. Changes to Terms
We may update these terms (30 days’ notice by email). Continued use = acceptance.
